Terms of Use for ScriptForge and ForgePad

These Terms of Use ("Terms") govern your access to and use of ScriptForge, the ScriptForge website and SaaS platform, the ForgePad Mac application, related websites, account services, subscription services, AI tools, credit systems, support channels, and related services (together, the "Service").

The Service is operated by Fear Army Limited, trading as Insane Rabbit Labs ("we", "our", or "us").

By accessing or using the Service, creating an account, purchasing credits, starting a subscription, or using ForgePad or ScriptForge, you agree to these Terms. If you do not agree, you must not use the Service.

1. The Service

ScriptForge provides web-based screenplay analysis, reporting, creative development tools, AI-assisted features, and related digital services.

ForgePad provides a Mac application for screenplay writing, project development, AI-assisted writing, analysis, reporting, image generation, productivity features, and related services.

ScriptForge and ForgePad may use a shared account, subscription, and entitlement system. This means that a subscription purchased through ScriptForge may unlock eligible ForgePad features, and a subscription purchased through ForgePad or the Apple App Store may unlock eligible ScriptForge features.

2. Accounts

You may need an account to use paid, cloud-enabled, subscription, credit, AI, or synced features.

You are responsible for keeping your login details secure and for all activity on your account. You must provide accurate information and keep it up to date.

You must not share, sell, transfer, or allow others to use your account unless we expressly permit this.

3. Licence to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for lawful personal, professional, or internal business creative development purposes.

You must not copy, resell, reverse engineer, scrape, misuse, disrupt, or attempt to gain unauthorised access to any part of the Service.

4. Your Content

You retain ownership of the scripts, notes, outlines, characters, dialogue, project material, prompts, uploaded files, generated materials, and other creative content you submit, create, upload, or store using the Service ("Your Content").

By using the Service, you grant us a limited licence to host, store, process, transmit, display, analyse, and otherwise use Your Content only as reasonably necessary to provide, maintain, secure, support, and improve the Service and to deliver the features you request.

We do not sell Your Content. We do not claim ownership of Your Content.

You are responsible for ensuring that you have the rights needed to submit, upload, process, or generate content through the Service.

5. AI Features

The Service may include AI-assisted features, including screenplay reports, rewrites, feedback, summaries, dialogue analysis, character or location analysis, image generation, table reads, brainstorming tools, and other creative outputs.

AI-generated content may be inaccurate, incomplete, repetitive, generic, unsuitable, or offensive. AI outputs are provided for creative assistance only and should not be treated as professional, legal, financial, commercial, or production advice.

You are responsible for reviewing, editing, and deciding whether to rely on or use any AI output.

We do not guarantee that AI outputs will be original, protectable, commercially useful, or free from similarity to other content.

6. Subscriptions, Credits, and Paid Features

The Service may offer free features, paid credits, monthly subscriptions, App Store subscriptions, website subscriptions, one-off purchases, and/or other paid features.

ScriptForge and ForgePad may use different credit systems. For example, ScriptForge may use report or service credits, while ForgePad may use monthly AI usage credits. These systems may be tracked separately even where a subscription gives access to both products.

Credits have no cash value, are not a stored-value product, and cannot be exchanged for money. Credits may only be used for eligible features within the Service.

Unless stated otherwise, credits are non-transferable and may expire, reset, or be replaced according to the relevant plan, subscription, or product rules.

We may set or change the number of credits required for features, including where provider costs, model costs, or feature complexity changes. We will not intentionally remove credits you have already paid for without good reason, but future feature pricing may change.

7. Standard and Pro Access

Paid plans may include shared access across ScriptForge and ForgePad. For example, a ScriptForge paid subscription may unlock eligible ForgePad features, and a ForgePad App Store subscription may unlock eligible ScriptForge features.

Standard plans may include a monthly allowance of ForgePad credits and a ScriptForge credit allowance or equivalent access, as described at the time of purchase.

Pro plans may be described as unlimited, but this is subject to fair use, technical limits, security controls, and anti-abuse rules. Pro access is intended for normal individual creative use, not bulk automation, resale, account sharing, scraping, excessive generation, or attempts to avoid usage limits.

We may apply rate limits, fair-use limits, temporary restrictions, or account review where usage is excessive, abusive, technically harmful, fraudulent, or materially outside normal use.

8. Apple App Store Purchases

If you purchase a ForgePad subscription through the Apple App Store or Mac App Store, Apple processes the payment, renewal, cancellation, refund, and billing relationship.

Apple may provide us with limited subscription and transaction information so we can unlock access, manage entitlements, and provide support.

You can manage or cancel App Store subscriptions through your Apple account settings. Refund requests for App Store purchases are handled by Apple under Apple's applicable terms and processes.

Where ForgePad is downloaded through Apple, Apple's applicable App Store terms and the Apple standard licensed application terms may also apply unless a separate custom EULA is provided.

9. Website Purchases and Stripe Payments

If you purchase credits, subscriptions, or paid features through ScriptForge, ForgePad, or our website, payments may be processed by Stripe or another payment provider.

Prices, renewal terms, taxes, billing periods, and plan features will be shown at checkout or in the relevant subscription page.

Subscriptions renew automatically unless cancelled before the renewal date. You are responsible for cancelling before renewal if you do not want the subscription to continue.

10. Refunds

Except where required by law or expressly stated otherwise, purchases of credits, reports, generated outputs, and digital services are final and non-refundable once used, delivered, generated, or made available.

We do not provide refunds simply because you are dissatisfied with subjective creative results, including AI opinions, report conclusions, image style, poster aesthetics, rewrite suggestions, or other creative outputs.

If a technical fault causes a failed generation, duplicated charge, missing credit grant, or similar issue, contact us within 7 days and we will review the issue. Where appropriate, we may restore credits, repeat a generation, or provide another remedy.

This does not affect any statutory consumer rights that cannot be excluded by law.

11. Acceptable Use

You must not use the Service to:

  • Break the law or infringe the rights of others
  • Upload or process content you do not have the right to use
  • Generate, distribute, or facilitate unlawful, abusive, exploitative, hateful, or harmful content
  • Harass, threaten, defame, impersonate, or deceive others
  • Attempt to bypass credits, subscriptions, rate limits, fair-use rules, or security controls
  • Scrape, overload, reverse engineer, interfere with, or disrupt the Service
  • Resell, sublicense, or commercially exploit the Service as a competing platform
  • Use automated systems or bots without our written permission
  • Upload malware, harmful code, or material intended to compromise systems

We may suspend or terminate accounts that breach these rules.

12. Intellectual Property

The Service, including our software, website, app design, source code, databases, branding, trademarks, logos, workflows, prompts, templates, interfaces, and documentation, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law or expressly allowed by us.

13. Third-Party Services

The Service may rely on or connect to third-party services, including Apple, Stripe, cloud infrastructure providers, AI providers, analytics providers, support providers, and storage services.

We are not responsible for third-party services, their availability, their terms, or their privacy practices. Your use of third-party services may be subject to their own terms.

14. Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation.

We may modify, suspend, discontinue, replace, rename, limit, or remove features at any time. We may also change models, providers, credit costs, limits, plan features, and technical requirements.

Where a material change negatively affects an active paid subscription, we will take reasonable steps to provide notice or a fair alternative where required by law.

15. Termination and Suspension

You may stop using the Service at any time. You may cancel subscriptions through the relevant platform or account settings.

We may suspend or terminate your access if you breach these Terms, misuse the Service, create legal risk, fail to pay, abuse credits or subscriptions, or use the Service in a way that harms us, users, providers, or systems.

Unused credits are not refundable on termination unless required by law or expressly agreed by us.

16. Disclaimers

The Service is provided on an "as is" and "as available" basis.

We do not guarantee that the Service or AI outputs will meet your expectations, produce commercially successful work, improve a script, secure financing, obtain representation, win competitions, satisfy industry readers, or be free from errors.

Creative feedback, analysis, scores, ratings, reports, and suggestions are subjective and advisory.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, including loss of profits, revenue, opportunity, goodwill, data, business, production value, or creative outcomes.

Nothing in these Terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any rights you have under applicable consumer law.

18. Consumer Rights

If you are a consumer, you may have legal rights that cannot be excluded or limited. Nothing in these Terms affects those rights.

For digital content or services that are supplied immediately, you may be asked to acknowledge that supply begins before the end of any cancellation period where applicable.

19. Privacy

Our use of personal information is described in our Privacy Policy. You should read it together with these Terms.

20. Changes to These Terms

We may update these Terms from time to time. The latest version will be made available on our website or through the Service.

If we make material changes, we may provide additional notice where appropriate. Your continued use of the Service after changes take effect means you accept the updated Terms.

21. Governing Law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, except where applicable consumer law gives you the right to bring proceedings elsewhere.
